Software License Agreement (EULA)

Grant

After Polar records a paid one-time order for the DiskPast product, you receive a license key. That key is proof of purchase. Activation binds one hashed Windows PC (a seat). You may deactivate in Settings or on /account and activate on another PC. Everyone receives the same installer; the key is what you purchased. The GUI, service, and CLI share that key.

A virtual machine, another Windows install, or another machine id counts as another PC. This license is not a concurrent, site, or terminal-server license. Linux is not the paid SKU.

There is no unpaid trial. Offline use after a successful activate or refresh is described under Offline grace, not as a trial period.

Updates

This license covers the DiskPast Windows Software as we distribute it for this product line (including ordinary version bumps of the same SKU). Separate Polar products (for example a later 2-PC or DiskPast+ SKU) are not included unless you buy them. We are not required to ship updates forever.

Restrictions

You may not:

• reverse engineer, decompile, or disassemble the Software except to the extent applicable law (including interoperability rules) does not allow us to prohibit it;
• rent, lease, sublicense, or sell the key or the Software;
• share the key so more seats run than you paid for;
• use a refunded, charged-back, or otherwise revoked key, or circumvent activation;
• remove proprietary notices, or use DiskPast marks except to identify the Software.

Activation and data

The Software posts the license key and a hashed device identifier to diskpast.com. We do not receive the raw MachineGuid. See the Privacy Policy. Signing into the website is not an activation.

Offline grace

After a successful activate or refresh against diskpast.com, the Software may keep history features working without the internet for 14 days. Each successful refresh starts that period over. That is not an unpaid trial and is not Polar’s refund window. If the license is revoked, the next refresh fails and this grace then ends.

Refund, chargeback, and revoke

If Polar refunds or a chargeback succeeds, we revoke the license. You must stop using history features when the license is revoked. See the Refund Policy.

Termination

This license ends if you breach it, if Polar reverses the Transaction, or if we revoke the key for that reason. On termination you must stop using the Software’s licensed features. Clauses that by nature should survive (including restrictions, disclaimer, and limitation of liability) survive.

Third-party components

The Software and Site may include third-party or open-source components under their own licenses. Those licenses apply to those components. This EULA does not reduce rights those licenses grant you in those components.

No warranty

THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that the Software will be error-free or that it will recover deleted files from a dead disk. Keep backups. We are not liable for data loss on your disk.

Nothing in this EULA limits rights you have as a consumer that cannot be limited or waived.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Our total liability arising out of the Software or this EULA is limited to the amounts you paid Polar for the DiskPast product giving rise to the claim. These limits do not apply to liability that cannot be limited under applicable law (including, where required, death or personal injury caused by negligence, or fraud).
